Judge’s retirement to move Devin Weiland trial along

(ABC6 News) – A new decision in the Devin Weiland case is expected by the end of the month.
On Monday, both sides of the case presented arguments as to whether Weiland, accused of shooting more than 70 bullets at civilians and police in Albert Lea in 2020, is mentally competent to stand trial.

Judge Steven Schwab took the arguments under advisement, and could have deliberated for three months before reaching a decision.
Freeborn County Court Administration noted, though, that Schwab will retire on March 31, and is expected to rule on or before that date.
A mental competency test should determine whether a defendant is capable of participating in their own defense, and rationally consulting with council.
Schwab had ordered competency evaluations in May and August of 2021.
Weiland does not have a new court date set.
