UPDATE: Austin man’s child rape plea deal falls through, trial scheduled

(ABC 6 News) – An Austin man is scheduled to stand trial on two 1st-degree criminal sexual conduct charges involving a child.

Alexander William Miller, 26, pleaded guilty to an amended charge of 2nd-degree criminal sexual conduct with a child in March, and was scheduled to be sentenced Aug. 1.

However, Miller withdrew his guilty plea and is now scheduled to appear for a pretrial hearing Jan. 17, followed by a jury trial beginning Jan. 27.

Miller’s court documents indicate that while he pleaded guilty in exchange for a recommended 6-month sentence, the presumptive sentence for 2nd-degree criminal sexual conduct was 60 months, or 5 years.

If convicted of 1st-degree criminal sexual conduct, Miller faces a presumptive sentence of 144 months, or 12 years.

(ABC 6 News) – An Austin man pleaded guilty to sexually assaulting a child, in exchange for a likely 6-month jail sentence.

Alexander William Miller, 26, pleaded guilty to an amended charge of 2nd-degree criminal sexual conduct with a child Thursday, March 28.

According to court documents, Mower County law enforcement put out a warrant for Miller’s arrest in June 2023, after a 13-year-old and her mother told Austin police Miller had assaulted the child in March of that year.

According to Miller’s plea agreement, his defense and prosecution agreed to recommend no more than 180 days of jail time at his sentencing June 7, along with probation.

(ABC 6 News) – An Austin man was arrested on two charges of sexually assaulting a child.

Alexander William Miller, 25, faces two charges of 1st-degree criminal sexual conduct with a child.

Miller was booked into the Mower County jail Monday, July 3 and appeared in court Wednesday, July 5.

According to court documents, Mower County law enforcement put out a warrant for Miller’s arrest in June, after a 13-year-old and her mother told Austin police Miller had assaulted the child in March of this year.

Mower County judge Kevin Siefken set Miller’s bail at $250,000 with no conditions, or $125,000 with conditions.

Miller’s next court appearance is scheduled for July 13.
