Parking dispute leads to assault charge

(ABC 6 News) — Rochester police said two men got into an argument over parking when one of them assaulted the other with a tire iron.

It happened just before 9:00 p.m. on Sunday, Oct. 3 on the 1900 block of 2 Ave SE in Rochester. A 45-year-old man who lives at the home said another man parked his car in front of his driveway. The man went out to confront the man and tell him to move his car. He told police that the man in the car said "are you threatening me?" and then grabbed a tire iron from his car and hit the 45-year-old with the iron.

By the time police got there, the suspect had taken off. The victim had been hit in the arm, and it appeared to be swollen and bleeding. He did not go to the hospital.

Police found the suspect at his own home a couple of blocks away. Rochester Police Sergeant Tony Teal identified the suspect as 35-year-old Sean Marshal. Sgt. Teal said Marshal denied the assault and denied getting into any confrontation with the victim. However, Sgt. Teal said Marshal told officers that the victim is always yelling at people for parking in front of his driveway.

Marshal was arrested and is facing charges of 2nd-degree assault and disorderly conduct.
