Rochester man sentenced to probation for drive-by shooting case
(ABC 6 News) – A Rochester drive-by shooting suspect received 5 years’ probation at his sentencing Oct. 16.
Anthony Lavell Frazier Jr., 20, previously pleaded guilty to a charge of drive-by shooting toward an occupied vehicle or building dating back to Sept. 25, 2023 on Chardonnay Lane NW.
All other charges from the drive-by shooting, as well as two aiding-and-abetting aggravated robbery charges from Sept. 20, were dismissed at sentencing.
In her downward departure report, Olmsted County judge Kathy Wallace cited Frazier Jr.’s particular amenability to probation as a factor in her decision.
According to court documents, the Olmsted County Attorney’s Office opposed the sentence.
Frazier was also ordered to spend 100 hours in community service, and another 100 hours ” talking to members of the community about what has been learned from this incident.”
If Frazier Jr. does not comply with the terms of his probation, he could be re-sentenced to 57 months, or nearly 5 years at the MN Correctional Facility in St. Cloud.
Christian Avery Miller, Frazier Jr.’s co-defendant in both September 2023 cases, pleaded guilty to drive-by shooting and simple robbery and was also sentenced Oct. 2 to 5 years’ probation and 200 hours of “meaningful service.”
