Austin man accused of 17 counts of sexually assaulting children moves to dismiss Florida charges
(ABC 6 News) – An Austin man accused of sexually assaulting three children between 2018 and 2022 moved to dismiss two of his 17 charges Friday, Oct. 18.
Miguel Angel Tovar-Calderon, 50, appeared for a Mower County pretrial hearing and entered a motion to dismiss counts 7 and 8 — both charges of 1st-degree criminal sexual conduct with a child under age 14.
“Specifically, the activity alleged in Counts 7 and 8 is alleged to have occurred in the State of Florida,” the motion reads.
The defense also moved for a review of various children’s therapy records, interviews referencing other sexual abuse incidents, and social service records.
Instead of a jury trial Oct. 28, Tovar-Calderon is now scheduled to appear for a motion hearing Nov. 22.

(ABC 6 News) – An Austin man accused of sexually assaulting three children between 2018 and 2022 is scheduled to stand trial on all charges July 29, 2024, with a pretrial hearing July 19.
Miguel Angel Tovar-Calderon, 49, was originally charged with six counts of 1st-degree criminal sexual conduct–victim under 13; 2 counts of 1st-degree criminal sexual conduct–victim under 14; one count of 1st-degree criminal sexual conduct–multiple acts over time; and one count of 2nd-degree criminal sexual conduct–victim under 18 in May of 2022.
According to court documents, in April of 2022, Mower County Human Services received a report that Tovar-Calderon had repeatedly raped and molested a nine-year-old girl over the course of several years.
In May of 2022, the child allegedly told a Child Protection Worker about eight separate incidents where Tovar-Calderon allegedly sexually assaulted her, beginning around age 5, and said it happened “a lot.”
Tovar-Calderon denied that any sexual contact had taken place, according to court documents.
Second round of allegations
According to court documents, in August of 2022, Tovar-Calderon was charged with three more counts of 1st-degree criminal sexual conduct–victim under 13; another count of 1st-degree criminal sexual conduct–multiple acts over time; and a count of 2nd-degree criminal sexual conduct–multiple acts over time for a total of 15 charges.
According to court documents, a then-11-year-old met with law enforcement and said she had also been sexually abused by Tovar-Calderon, beginning when she was 8 and ending when she was 10.
The 11-year-old described five alleged assaults, but estimated that it had happened around 20 times over two years, according to court documents.
Third round of allegations
In January of 2023, another 10-year-old child met with Mower County law enforcement and reported that she had been assaulted by Tovar Calderon on multiple occasions, according to court documents.
Tovar-Calderon was charged with another count each of 1st-degree criminal sexual conduct–multiple acts over time and 2nd-degree criminal sexual conduct–multiple acts over time, for a total of 17 charges in May of 2023.
The third child said the abuse had started when she was 6 and ended the previous year. She described five specific alleged molestations, and estimated “more than 10” total incidents.
