Concordia wrestler begins sentence for criminal sexual conduct 5 1/2 years after fleeing legal system

(ABC 6 News) – UPDATE: Dereck Samudio was granted a Sentence to Serve approval June 12, which allows nonviolent offenders to work on community projects.
A Concordia University wrestler was sentenced to 30 days in Freeborn County jail Thursday — a sentence that arrived 5 1/2 years after his criminal sexual conduct conviction, and nearly 8 years after the crime was committed.
According to court documents, 25-year-old Dereck Anthony Samudio, an Albert Lea resident at the time, was accused of two counts of 3rd-degree criminal sexual conduct of a 14-year-old juvenile in May of 2015.
Samudio was 18 years old at the time, and was thus more than 24 months older than the juvenile girl.
Samudio pleaded guilty to one count of 5th-degree criminal sexual conduct–lewd exhibition/child under 16 present in October of 2016, and was convicted.

However, according to court documents, Samudio was ordered to undergo a psychosexual evaluation as part of his plea deal, and did not complete the order.
Then three warrants were issued for Samudio’s arrest after failing to appear at sentencing hearings in 2017.
The last warrant, issued in September of 2017, remained open until Feb. 7, 2023.
According to court documents, Samudio was located on the Concordia University wrestling team in Seward, Nebraska in December 2022.
According to court records, Samudio and his family were contacted, and Samudio agreed to complete his psycho-sexual evaluation in December of 2022, then did not contact Freeborn County Court for another month.
“At this point in time, the Defendant is willfully refusing to appear in this matter,” court records read.
Samudio’s arrest warrant was finally served Feb. 7, but another warrant for his arrest was immediately filed Feb. 8 after Samudio allegedly failed to pay bail.
He is currently listed as “in custody” at the Seward County Jail in Nebraska.
Samudio was sentenced remotely to 30 days in Freeborn County Jail Thursday, March 2.
According to Freeborn County court staff, Samudio will begin his jail sentence June 15, 2023.
Samudio also received a suspended sentence of 335 additional days in jail, which will be stayed for two years as long as he follows the conditions of his probation.
