Austin man sentenced to 60 days in jail, 5 years’ probation following country club incident

(ABC 6 News) – An Austin man will spend 5 years on probation after threatening another country club client with a knife.

Jeremiah Phelps, 37, pleaded guilty to 2nd-degree assault in May after an incident wherein he allegedly got into a fight at a Hayfield country club, then spat vomit onto a sheriff’s deputy in January.

Phelps was sentenced to 57 months at the MN Correctional Facility in St. Cloud, but that sentence has been stayed for 5 years, while Phelps completed supervised probation.

If Phelps violates the terms of his probation, he could be re-sentenced to prison time.

Phelps also received an executed sentence of 60 days in jail, with credit for one day already served.

According to Minnesota court records, Phelps may serve the time in Olmsted or Mower County, and was granted work release.

(ABC 6 News) – An Austin man arrested in Hayfield Jan. 8 pleaded guilty to threatening another country club client with a knife.

Jeremiah Phelps, 37, pleaded guilty to 2nd-degree assault with a deadly weapon in Dodge County Court Wednesday, May 17.

According to court documents, Phelps was arrested after leaving the Hayfield country club, when Dodge County deputies located him on 170th Avenue.

Deputies claimed that Phelps did not comply with orders to get on the ground until he slipped on ice, smelled heavily of alcohol, and had a knife in his pocket.

According to court documents, Phelps allegedly admitted to getting into a fight at the country club, then vomited in his mouth and spat the vomit onto a deputy.

According to Phelps’ plea deal, he is expected to be sentenced to 60 days in jail, and the remaining charges of 4th-degree assault of a peace officer–transfer bodily fluids, 5th-degree assault–attempt bodily harm, disorderly conduct, obstruction of the legal process, and fleeing a peace officer on foot will be dismissed.

His sentencing is scheduled for July 26.

(ABC 6 News) – An Austin man was arrested and arraigned in Dodge County after an alleged incident at the Oaks Country Club in Hayfield.

According to court documents, a Dodge County sheriff’s deputy was dispatched to the country club Sunday, Jan. 8 after multiple calls claiming a man was threatening another man with a knife.

Dispatch told the deputy that the suspect had called 9-1-1 himself and said deputies “better be ready to square off.”

The deputy located 36-year-old Jeremiah Phelps of Austin walking southbound on 170th Avenue, the same street as the club.

Phelps allegedly told the deputy to shoot him and began walking away. According to court documents, the deputy told Phelps to get on the ground multiple times, but he did not comply until he slipped on ice and struck his face on the road.

Phelps allegedly got up afterward and walked toward the deputy, who noticed a pocket knife in his front pocket.

According to court documents, the deputy arrested Phelps, noted a strong scent of alcohol, removed the pocket knife, and called an ambulance to the scene to assess Phelps’ condition after hitting his head, which was bleeding.

Phelps allegedly admitted to getting into a fight at the country club, then vomited in his mouth and spat the vomit onto the deputy.

He was taken to St. Mary’s hospital and treated, then transferred to the Olmsted County Adult Detention Center.

Phelps faces charges of 2nd-degree assault with a deadly weapon, 4th-degree assault of a peace officer–transfer bodily fluids, 5th-degree assault–attempt bodily harm, disorderly conduct, obstruction of the legal process, and fleeing a peace officer on foot.
