UPDATE: Judge to consider Fravel’s murder trial location
(ABC 6 News) – A Winona judge will consider whether or not Adam Fravel can be fairly tried in Winona County, and return an answer at a later date.
Judge Nancy Buytendorp said she would take arguments concerning Fravel’s trial location under advisement in the next months at Tuesday’s omnibus hearing.
Fravel’s defense moved to have the trial held outside of Winona County, claiming media coverage of the case will make it nigh-impossible to locate an impartial jury.
The state objected to the motion.
Fravel’s defense has until May 17 to enter an argument, and the state has until May 31 to respond, according to the hearing.
Rebuttals are due by June 7, and Buytendorp will take all of the material under advisement June 10, according to court proceedings.
Fravel’s jury trial has not been scheduled.
—–PREVIOUS STORY—–
(ABC 6 News) – On Tuesday April 30, the man accused of murdering Madeline Kingsbury is back in Winona County Court for a third omnibus hearing.
Adam Fravel is charged with two counts of first-degree murder and two counts of second-degree murder in the death of Kingsbury, the mother of his two children.
In March, two omnibus hearings were held regarding the grand jury trial transcript, and a motion to dismiss the charge of first degree murder.
Tuesday’s omnibus hearing focuses on the location of Fravel’s trial. The defense arguing there is a need to move the case out of Winona County due to worry about the ability of seating and impartial jury to due media coverage of the case.
