Number of charges reduced for Rochester man accused of making, sharing child pornography

(ABC 6 News) – UPDATE: A Rochester man is accused of making and disseminating child pornography faces two fewer 1st-degree criminal sexual conduct charges, according to an amended criminal complaint filed Tuesday, March 26.

Kevyn Bradley Heath, 27, was originally charged with three counts of 1st-degree criminal sexual conduct with a child; one count of use of a child in a sexual performance or pornographic work, and one count of dissemination of child pornography.

He now faces only one count of 1st-degree criminal sexual conduct with a child; one count of use of a child in a sexual performance or pornographic work, and one count of dissemination of child pornography.

The prosecution filed a motion to seek aggravated, or unusually severe sentencing if Heath is convicted, based on the age of the child (under 3) and multiple alleged forms of sexual penetration and contact described in Heath’s charging documents.

Heath is currently held on $1,000,000 bail or bond, and is scheduled to appear again in court May 16.

(ABC 6 News) – A Rochester man is accused of making and disseminating child pornography.

According to RPD Lt. Jennifer Hodgman, investigators served a search warrant in the 4000 block of Valley Drive NW Monday, and took 27-year-old Kevyn Bradley Heath into custody.

Police say they received an Internet Crimes Against Children (ICAC) tip alleging that a local couple was creating child pornography, which was collected by a social media account.

According to Rochester police, investigators now believe Heath was acting alone.

He allegedly admitted to sexual conduct with a child under age 3 when police served the search warrant and interviewed him Monday.

Heath was charged Wednesday, March 13, with three counts of 1st-degree criminal sexual conduct with a child; one count of use of a child in a sexual performance or pornographic work, and one count of dissemination of child pornography.

Court documents allege that the ICAC tip referenced documents from Discord, a social media messaging platform, wherein Heath allegedly spoke to a person identifying as a juvenile about sexual conduct, then sent explicit photos.

Another Discord conversation allegedly described a sexual interaction between him and the child under age 3, as well as explicit photos and videos.

Heath is currently held on $1,000,000 bail or bond, and is scheduled to appear again in court March 26.
